Terms of Service

1. The service

Tunely is an AI-assisted tool that generates songs, lyrics, and related audio from the prompts and lyrics you provide. Output is produced automatically and may vary in quality, originality, and suitability.

2. Eligibility & accounts

You must be at least 16 years old to use Tunely. We sign you in with a one-time code sent to your email, so you are responsible for keeping access to your email secure and for all activity under your account.

3. Acceptable use

You agree not to use Tunely to: break the law; create content that infringes someone else's intellectual property; impersonate a real person's voice or identity; produce hateful, harassing, or deceptive material; or abuse free credits, reverse-engineer, scrape, overload, or otherwise disrupt the service.

4. Credits, plans & billing

Generating music uses credits. Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor and renew automatically until you cancel.

You can cancel anytime from your account. Your plan stays active until the end of the current billing period; partial periods aren't refunded.

If a renewal payment fails, your account works as a free account until a payment goes through: no new monthly credits and no paid features. We retry the charge automatically, and once it succeeds your plan and that month's credits come back. When a paid plan ends — you cancel it, it isn't renewed, or a renewal is never paid — your account returns to the free plan. What you obtained while your plan was paid stays yours (see section 6).

You can hold one subscription at a time; to move between Pro and Ultra, use the plan switch on the pricing page. Upgrading from Pro to Ultra takes effect once the prorated difference for the rest of the current billing period is paid: your billing date stays the same, you keep your remaining credits and receive a share of Ultra's extra monthly credits in proportion to the time left in the current month, and if that payment fails nothing changes. Downgrading from Ultra to Pro takes effect at your next renewal: you keep Ultra until then, the rest of the current period isn't refunded, and you can cancel the downgrade at any time before it takes effect. Plan changes are paused while a renewal payment is unpaid. To switch between monthly and annual billing, contact us.

5. Refunds

Because each generation immediately consumes computing resources, fees are generally non-refundable once credits have been used. If you believe you were charged in error or experienced a technical failure, contact us within 14 days of the charge and we will review your request in good faith.

6. Your content & ownership

You keep all rights to the prompts and lyrics you provide. Subject to these Terms and your plan, you own the songs you generate with Tunely.

While a paid plan (Pro or Ultra) is active and paid, every song in your library comes with a worldwide, royalty-free, perpetual, non-exclusive commercial licence — the right to sell, monetize, publish, and sync it for business — including songs you first made on the free plan. You can view and download a per-track licence certificate from your library as proof. What you obtain during paid time is yours permanently: songs that were in your library while your plan was paid keep their commercial licence and their downloads, even if you later change or cancel your plan. Songs you make after paid time ends, or while a renewal payment is unpaid, are free-tier songs (personal use, downloads on free-plan terms) unless you start a paid plan again. A payment that is refunded or charged back doesn't count as paid time. Free-tier output is for personal, non-commercial use only.

Songs are produced by AI. Where a platform or the law requires it, please disclose that a track was AI-generated. As with all generative audio, we can't guarantee output is wholly unique, and AI-generated material may not be eligible for copyright in every jurisdiction; you use it on that basis.

7. Our intellectual property

The Tunely name, website, design, and software belong to us. We grant you a limited, non-exclusive, non-transferable licence to use the service as intended.

8. Third-party services

We rely on third-party infrastructure and AI providers to operate Tunely. Their availability, changes, or limits may affect the service, and we are not responsible for their actions.

9. Disclaimers

The service and all AI output are provided “as is” and “as available,” without warranties of any kind. AI output may be inaccurate, unoriginal, or unsuitable for your purpose. You are responsible for reviewing output before relying on or publishing it.

10. Limitation of liability

To the maximum extent permitted by law, Tunely and its operators will not be liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Suspension & termination

We may suspend or terminate accounts that violate these Terms or that we reasonably believe are abusing the service.

12. Changes to these Terms

We may update these Terms from time to time. We'll update the date above, and your continued use of the service means you accept the changes.

13. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules.
